1. Acceptance of Terms

By accessing or using the Xpego platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

These Terms constitute a legally binding agreement between you and Xpego Tech Private Limited ("Xpego", "we", "us").

2. The Xpego Platform

Xpego is a discovery and booking platform that connects consumers with curated experience brands in India. We operate a concierge model where our team personally confirms slot availability and connects you with the experience brand.

During our current launch phase, Xpego does not process payments directly. Payment is made directly between you and the experience brand as facilitated by our concierge.

3. Eligibility

You must be at least 18 years old to create an account on Xpego. For experiences marked "Adults only", all attendees must be 18 or older. For experiences with age restrictions, you are responsible for ensuring all guests meet the requirements.

4. Your Account

You are responsible for:

Maintaining the confidentiality of your account credentials
All activity that occurs under your account
Providing accurate and complete information
Notifying us immediately of any unauthorised use

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Expressing Interest

When you express interest in an experience:

You are indicating genuine intent to book, not a confirmed reservation
Our concierge will contact the brand to confirm availability
We will contact you via WhatsApp within 24 hours with a confirmation or alternative options
Expressing interest does not guarantee a booking or obligate you to pay

6. Bookings and Payments

When a booking is confirmed through our concierge:

You agree to honour the booking and attend the experience
Payment terms are as communicated by our concierge and the brand
Cancellations must be made at least 24 hours before the experience
No-shows may result in charges at the brand's discretion

When our payment engine is enabled, additional payment terms will apply and will be presented to you at the time of booking.

7. Experience Brands

Xpego verifies experience brands before listing them. However:

Xpego is not responsible for the quality, safety, or delivery of experiences
Each brand operates independently and is responsible for their listings
In case of disputes with a brand, contact us at legal@xpego.com and we will assist in resolution

8. Prohibited Conduct

You agree not to:

Provide false information when expressing interest or booking
Abuse or harass brand hosts or Xpego staff
Use the Platform for any unlawful purpose
Attempt to circumvent or manipulate the Platform
Create multiple accounts to abuse the interest or booking system

9. Intellectual Property

All content on the Xpego Platform including text, graphics, logos, and software is owned by Xpego Tech Private Limited or its licensors. You may not reproduce, distribute, or create derivative works without our written permission.

Experience photos and brand content remain the property of the respective brands.

10. Limitation of Liability

To the maximum extent permitted by law, Xpego shall not be liable for:

Any indirect, incidental, or consequential damages
Loss of data or profits
Personal injury or property damage arising from experiences booked through the Platform
Actions or omissions of experience brands

Our total liability to you shall not exceed the amount paid by you for the relevant experience.

11. Indemnification

You agree to indemnify Xpego against any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.

12. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Bengaluru, Karnataka.

13. Changes to Terms

We may update these Terms at any time. We will notify you of material changes via WhatsApp or email. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
